What to Do if You’re Injured Through the Negligence of Another
When you leave the house, you never expect to be involved in an accident. Although accidents do happen, sometimes your injury can be caused by the negligence of another person. Here’s more about what constitutes negligence on someone else’s part and what exactly you should do after your accident in order to best prepare for your potential case.
In order to prove that someone has been negligent, you have to be able to prove that your injury is the direct result of the other party acting irresponsibly. Additionally, you must have injuries that would not have happened if the accident hadn’t occurred.
Automobile accidents, workplace accidents, and medical malpractice suits are often filed on the basis of alleged negligence. These aren’t the only instances for negligence claims. You might also be able to file for negligence if you slipped and fell in a store or even in a neighbor’s house.
After the Accident
Immediately after the accident, get yourself to safety. Your health and safety should be your top priority. Once you are in a safe place, evaluate your situation. If you think the police might need to be involved (like in the case of an automobile accident), call them immediately.
Also, if you are in pain, call the ambulance immediately. Everything else can wait until after you receive medical attention. If you’re not in pain after your accident and believe that your medical care can be temporarily postponed, document the scene of the incident. Take pictures, list witnesses, and make sure to get the name and insurance information of the other party.
Next, seek medical attention if you have not yet. Even if you feel like you’re okay, you need to see a doctor to get checked out. Remember, while you may feel okay immediately after an accident, you might feel horrible tomorrow. Do not go home until after you have been cleared by a doctor.
Finally, contact a qualified personal injury lawyer to discuss your case.
