The Three Stages of Felony Cases

There are three primary stages during felony cases; however in these stages are many steps that must be followed. These steps will assist in assuring you have the most favorable outcome in your case.

The three stages of felony cases are as follows:

Stage 1: Investigation

This stage can last anywhere between a day to several months, depending when and where you were arrested following the crime. If you were arrested at the scene of the crime, this stage will typically be shorter, however if you are not arrested right away, this phase may last longer. However, a knowledgeable Nebraska criminal defense attorney may be able to speak with a detective in order to convince them to begin proceeding with the case.

Stage 2: Pre-Trial

At the point a detective determines that your case has sufficient evidence to present your case to the Assistant District Attorney, the pre-trail phase will be initiated. While presenting your case to the Assistance District Attorney, your lawyer may explain how you are innocent, or explain the problems with your case in order to convince the Assistant District Attorney to present your case to the grand jury. At this time, you may be able to negotiate a favorable plea bargain. After your case has been presented to the Grand Jury, it will be determined if there is probable cause to indict you. If you are indicted, the next phase will begin.

Stage 3: Trial

After you have been indicted in Omaha, you will have the right to a trial by jury. Typically at this time, your lawyer will be researching arguments and trial strategies used to obtain favorable verdicts in similar cases. During this time you can discuss the strengths and weaknesses regarding your case and see if there is anything you can do to help formulate a more robust case.  Near the end of the trail, there may be time to make a favorable plea bargain, while this time is often used to get an unreasonable prosecutor to offer a reasonable deal.
